Illegal parking in the Tedi parking lot: Lawyers GmbH initiates the next escalation level

Those who park illegally in a Tedi parking lot in Lower Saxony receive mail from a Cologne law firm. You should sign a cease and desist declaration – violations could result in a fine of up to 1,000 euros.
Barrien – Great anger, uncertainty especially among older people and a drop in sales for the local “lucky guy”. This situation is likely to be unique in Barrien’s recent history. Since the beginning of the year, both locals and foreigners have been receiving mail with hefty payment requests of up to over 200 euros. The senders are debt collection agencies that allegedly act on behalf of two private parking enforcement companies. The accusation: People parked on Barrier Street in front of the Tedi market, even though they didn’t buy anything there.
The latest chapter in history sparks the next level of escalation: those affected by illegal parking are now receiving mail from the Cologne-based Lectio Rechtsanwalts-GmbH. This company is known in consumer reports as a mass warning and money collector for third-party companies. It achieves the feat of having an average Google rating of exactly one star (out of 43 reviews).
Illegal parking in Barrien: Law firm demands cease and desist
The company asks vehicle owners to sign a cease and desist declaration. The vehicle owner should undertake not to park in the Tedi parking area without the consent of the property owner Sven Lahmeyer. In the event of a violation, there is a risk of a contractual penalty of up to 1,000 euros. On top of that, there is a “cost note” of 232 euros that the alleged parking offenders would have to pay to the law firm.

Sven Lahmeyer contacted the companies because he was annoyed by the unjustified parking. “Lucky” customers, visitors to the barrier cemetery across the street and the sports hall just around the corner and even Tedi customers have come into the eyes of Lahmeyer and the parking lot monitors. The people, in turn, sought advice from the city of Syke, from local mayor Christian Eilers, from the Barrien local council and from the Kreiszeitung media group. Parking in the parking lot should no longer be allowed after decades? Many people don’t want to get that into their heads.
The uncertainty is so great that those affected report in large numbers to the Kreiszeitung media group – in the morning, at lunchtime and sometimes late in the evening. “What should I do?” is the most frequently asked question. The conversation always ends with a reference to the Lower Saxony consumer advice center and the complaints office of the Federal Office of Justice. Journalists cannot and are not allowed to provide legal advice.
Several callers announced that they would object to the request. Others hire a lawyer. They probably have to bear the costs themselves; according to one of those affected, the legal protection insurance does not cover this. The third group of those affected “just want to be left alone,” as one person puts it. Those people transfer. Still others would like to wait out the issue: They do not believe that the “completely exaggerated” claims would hold up in court. In addition, the information signs put up by Lahmeyer were nowhere near the required size, according to a belief expressed several times.

Many of those affected agree that they will no longer shop at Tedi in Barrien in the future and will certainly not park there. Nothing is currently happening there in terms of parking monitoring. But the uncertainty runs deep. And then there is “Glückpilz” owner Rainer Lichtlein. The dispute with Lahmeyer over parking spaces almost cost him his existence. All of this concerns people in Barrien and surrounding areas. “It’s the issue at all,” says one affected person. Property owner Lahmeyer is satisfied. Firstly, the second parking enforcement company he hired works well, he assures us. Secondly, the whole situation has now calmed down. There are almost no “wild parkers” anymore. His parking lot is currently not monitored. There are new signs in his garage. But Lahmeyer currently sees no need to install these.
Of course, the Kreiszeitung media group would also like to know from tenant Tedi what the company thinks of what is happening in Barrien. The press office responded to the four questions posed by email with a two-line sentence without specifically addressing the questions: “So that our customers can use the parking spaces in front of our store, parking space monitoring is necessary on the part of the landlord. The service provider is available to assist you with any questions or goodwill decisions.”
